Asylum-seekers can apply for refugee status regardless of their visa status. Refugee status applicants with valid visa status will receive G-1-5 visa and will be issued with an Alien Registration Card, if they do not already have one. The G-1-5 visa will generally be valid for three months, so the refugee status applicant will need to extend it each time before it expires.
Refugee status applicants, whose visa has expired and who do not have a valid visa at the time they make their refugee status application will need to clear their visa status after they have made their refugee status application. According to Korean domestic law5, a person who does not have a valid visa to stay in Korea may be arrested and detained, or asked to pay a fine. Asylum-seekers, who do not have a valid visa, but have completed their refugee status application will not generally be detained. However, in order to obtain the G-1-5 visa they may be required to pay a fine. Refugee status applicants who are not able to pay the fine will not be issued with an Alien Registration Card. Refugee status applicants will need to go to the immigration office in their area of residence for visa related matters.
Medical check-up
After refugee status applicants have completed the application process, they will have the opportunity for a free medical check-up at a nearby public medical clinic within a month after they make their refugee status application. This medical check-up is optional, and will not affect the refugee status determination process.
Notifying changes in personal contact information
Refugee status applicants must inform the immigration office in their area of residence of any change in residential address or contact telephone number. Failing to keep the immigration office informed of personal contact details affects the immigration office’s ability to contact the refugee status applicant during the refugee status determination process. If the immigration office is unable to contact the applicant three consecutive times by telephone, once by letter, and by a notice on their office notice board, the refugee status application will be considered as withdrawn.
